1. About Formula D1

Formula D1 provides tools to help student-athletes research college athletic programs, organize recruiting opportunities, prepare outreach messages, and communicate with college coaches. Formula D1 is an independent recruiting technology platform. It is not affiliated with or endorsed by the NCAA, an athletic conference, or a college unless expressly stated.

2. Eligibility and accounts

You must be at least 13 years old to use Formula D1. If you are under 18, you must have permission from a parent or legal guardian where required by law. You agree to provide accurate account information and to keep your sign-in credentials secure.

3. Accounts and acceptable use

You are responsible for activity conducted through your account. You may not:

• Access an account or information without authorization.
• Scrape, harvest, systematically extract, or resell coach contact information or other platform data.
• Circumvent subscription restrictions, usage limits, or security controls.
• Send unlawful, deceptive, harassing, or otherwise prohibited communications.
• Use automated systems to abuse platform features, or interfere with the platform’s operation or security.
• Misrepresent your identity or athletic qualifications.

We may restrict or suspend access for violations of these Terms, fraud, or security threats, consistent with applicable law.

4. Recruiting tools and communications

Recruiting information and communication tools are provided for informational and organizational purposes. You are responsible for reviewing each message and deciding whether to send it. When you approve a message through the connected Gmail feature, you authorize Formula D1 to facilitate sending it from that connected account.

You are responsible for complying with applicable email and communication laws, Google policies, and relevant recruiting rules. Coach information, school information, recommendations, and contact details may change or contain inaccuracies. Email open tracking can be approximate because email providers may proxy or pre-load images and links.

5. No recruiting guarantee

Formula D1 does not guarantee a scholarship or athletic offer, a response from a coach, college admission, recruitment by a program, or the accuracy or continued availability of a particular coach contact. Recruiting outcomes depend on factors outside Formula D1’s control.

6. Subscription pricing and automatic renewal

Formula D1 offers free and paid access, subject to the features and limits displayed in the platform. The All Access subscription is currently $349.99 per year, unless a different price or promotion is clearly displayed before you purchase. Taxes may apply.

The paid subscription renews automatically each year at the price and billing frequency disclosed at checkout until you cancel. By subscribing, you authorize recurring charges to your selected payment method. Any price changes and required renewal notices will be handled as required by law.

7. Cancellation

You can cancel at any time to prevent future annual renewals. In the app, open Profile → Manage Subscription to access the Stripe Customer Portal and use the cancellation option available for your subscription. If you cannot access that option, contact jack@acquisitionenterprises.net for help before your next renewal.

Canceling does not automatically issue a refund. Unless refunded or otherwise terminated, paid access continues through the current billing period. Nothing in these Terms limits cancellation rights that cannot legally be waived.

8. 14-day money-back guarantee

This refund guarantee does not limit consumer rights that cannot legally be waived.

9. Payments

Payments are processed by Stripe or another payment provider disclosed at checkout. You must provide valid payment information and authorize charges for your selected subscription. Paid features may be suspended if payment fails, subject to applicable law.

10. Content and intellectual property

Formula D1 and its licensors own the platform software, design, branding, and proprietary content. We grant you a limited, personal, nonexclusive, nontransferable right to use the platform in accordance with these Terms. You may not copy, distribute, resell, or reverse engineer protected materials except as permitted by law.

You retain ownership of the information and content you submit. You give Formula D1 the limited permission needed to store, display, and process that content to operate the service and provide features you request, including preparing and sending messages you approve.

11. Privacy and third-party services

Your use of Formula D1 is also governed by our Privacy Policy. Formula D1 may integrate with Google, Stripe, hosting, email-delivery, and other providers. Those providers may have their own terms and privacy policies. We are not responsible for independent service interruptions or product changes by third parties, except as required by law.

12. Service changes and termination

We may update, maintain, or modify the platform to improve its features, security, or performance. We do not guarantee uninterrupted service. Material changes affecting paid subscriptions will be handled according to applicable law.

You may stop using Formula D1 at any time. We may suspend or terminate access for material violations of these Terms, fraud, security threats, or other lawful reasons. Termination does not eliminate accrued payment obligations or legally protected refund rights.

13. Disclaimers, liability, and governing law

To the extent permitted by law, Formula D1 is provided on an “as available” basis. We do not warrant that recruiting results, communications, or platform information will meet every user’s expectations. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

To the extent permitted by law, Formula D1 is not liable for indirect, incidental, special, or consequential damages arising from use of the platform. This limitation is subject to applicable consumer-protection laws and other nonwaivable rights.

These Terms are governed by the laws of the State of Connecticut, subject to mandatory consumer protections and other applicable law.

14. Changes and contact

We may revise these Terms periodically. We will post the updated Terms with a new effective date and provide additional notice or obtain consent where required.
